Why can't I pay my real estate agent a "performance bonus" for negotiating me a lower price on the home I want to buy or for getting me a higher price when I am trying to sell?
Answer:
(Although this answer may sound absurd, it is the truth and can be found in actual provincial legislation.)
Once a home is listed for sale by a real estate agent all other agents in the province must abide by that price. No matter how the price was arrived at, NO agent in the province can suggest that the home is worth anything other than its listed price, without the agent who states otherwise risking prosecution. As a matter of fact agents are not even allowed to make comments about home prices at their own backyard BBQ, without risking prosecution for breach of regulations.
This is why when you ask an agent "what do you think of the listing price" the agent legally must reverse the question back on you,
for you to answer yourself.
Therefore since paying a "performance bonus" where a seller gets a better price or a buyer obtains a lower price, would suggest the agent must have stated the home was worth a price other than what it was actually listed for which is not allowed. Thus an agent legally cannot help you getting a higher or lower price than the one asked and cannot be financially rewarded as such.
Note: If in fact they do comment on prices, you the consumer can seek financial compensation for that advice being given.
